Cndepot Service Terms

Please read the Cndepot Service Terms carefully and ensure that you fully understand these terms before registering as a user. Please read carefully and choose to accept or not accept the Cndepot Service Terms, especially the terms of exemption or limitation of liability, governing law, and dispute resolution. Unless you accept these Cndepot Service Terms, you have no right to register, log in, or use the services of Cndepot. Your registration, login, and use will be deemed as acceptance of the Cndepot Service Terms and you agree to be bound by them.

The Cndepot Service Terms set forth the rights and obligations of Cndepot and you with respect to the Cndepot Services (the “Services”). These Cndepot Service Terms may be updated by Cndepot at any time. Once published and publicized, the updated Cndepot Service Terms will replace the original terms without prior notice. You may refer to the latest version of the Cndepot Service Terms on the Cndepot platform. You are advised to keep abreast of the updated Cndepot Service Terms to avoid unnecessary misunderstandings and disputes. After modification of the Cndepot Service Terms, if you do not accept the modified terms, please immediately stop using the Services provided by Cndepot. Your continued use of the Services will be deemed as acceptance of the modified Cndepot Service Terms.

1. Scope of Application of the Terms of Service

The ownership and operation rights of the relevant registered user services belong to “Cndepot Technology Co., Limited” (“us”), and the services provided must be implemented in accordance with the service regulations, terms, and operating specifications issued by us. This represents that the relevant users and Cndepot have reached an agreement and accepted all our terms of service.

2. Information Collection and Use

When you use Cndepot’s services, your personal information that we may need to collect and use includes the following two types:

2.1 Essential Information

To provide you with the basic functions of our services, you must authorize us to collect and use the necessary information. If you refuse to provide the corresponding information, you will not be able to register, log in, or use our services normally.

2.2 Optional Information

To provide you with additional functions of our services, you can choose to individually agree or disagree with the information we collect and use. If you refuse to provide it, you will not be able to use the relevant additional functions normally or achieve the intended functional effects, but this will not affect your use of our basic functions.

We protect your right to know and your right to choose during installation or use in accordance with the law. During your use of Cndepot services, services involving functions provided on your devices shall be subject to your prior consent. Upon your confirmation, Cndepot has the right to enable necessary auxiliary functions such as collecting geographical locations, reading contact books, using cameras, and enabling recording services.

The information collected and used shall include but not be limited to the user’s name, contact information, and other basic information. The user agrees that the use of such information shall be subject to the provisions of Article 3 “User Information Protection.”

3. User Information Protection

We will not disclose or share your personal information with third parties unless:

Sharing is necessary to fulfill legal obligations.

3.2 User Consent

Sharing is done with your consent.

4. User Rights and Obligations

4.1 Access and Correction

You have the right to log in to the Cndepot website and review, correct, and supplement your personal information.

4.2 Account Cancellation

You have the right to contact online customer service and request to cancel your account. After you voluntarily cancel your account, we will stop providing services for you and delete or anonymize your personal information according to applicable laws.

4.3 Automated Decision-Making

In some business functions, we may make decisions based on non-human automatic decision-making mechanisms, including algorithms. If these decisions affect your legitimate rights and interests, you can contact us through customer service.

4.4 Information Authenticity

All information you provide to Cndepot shall be true, accurate, and not misleading. You understand and agree that you are obligated to maintain the authenticity and validity of the information you provide.

4.5 Prohibited Content

You may not use your registered account or Cndepot services to create, upload, copy, publish, or disseminate content that interferes with the normal operation of Cndepot or infringes the legitimate rights and interests of other users or third parties.

4.6 Commercial Use

You may not copy, sell, resell, or use for any other commercial purpose any part of the Cndepot Services or the content used or obtained by Cndepot Services.

4.7 Responsibility for Information

You are solely responsible for the authenticity, legality, accuracy, and validity of any information transmitted using your Cndepot account or Cndepot services. Any legal liability in connection with any information transmitted by you shall be borne by you and shall not be related to Cndepot. You shall indemnify Cndepot or any third party for any damage caused thereby, and Cndepot reserves the right to hold relevant users and accounts liable.

4.8 Account Activity

You are responsible for the results of all actions under your account (including but not limited to signing various agreements online, publishing information, purchasing goods and services, and disclosing information).

5. Storage of Information

“Cndepot” does not set an upper limit on the amount of information transmitted. We have taken reasonable and feasible security protection measures in line with industry standards to protect your information and prevent personal information from unauthorized access, public disclosure, use, modification, damage, or loss. In addition, please properly protect your personal information, only provide it to others when necessary, and do not engage in transactions through other trading tools to avoid information theft or online fraud.

6. Exemption from Liability

6.1 Product Information

The product information provided by Cndepot will restore the real situation as much as possible. However, due to various factors such as the surrounding environment, shooting angle, equipment differences, and other factors during product photography, we cannot guarantee that the product will be exactly the same.

6.2 Purchase Issues

Cndepot purchases the designated products according to the platform specified by the user. If the platform shows out of stock, price changes, untimely delivery, inconsistency between the real products and the product information on the website, abnormal goods, or other irresistible factors resulting in the normal purchase not being completed, we will communicate with you in time. “Cndepot” will not be held responsible for any loss caused to you.

6.3 After-Sales Issues

If the products purchased by Cndepot for you involve after-sales (such as missing products, damage, defects, etc.), we will deal with them in time for you.

6.4 Account Security

Cndepot shall not be held liable for any loss or consequence caused by your active disclosure of your Cndepot account or attacks or fraud by others. You shall seek compensation from the infringer through judicial remedy or other means.

7. Prohibited Acts

You cannot use the Cndepot service for the following activities:

7.1 Legal Violations

Violation of any law, regulation, decree, or regulation.

7.2 Prohibited Transactions

In connection with transactions involving:

7.2.1 Dangerous Products

Narcotics, steroids, certain regulated drugs, or other products that may endanger consumer safety;

7.2.2 Drug Paraphernalia

Drug paraphernalia;

7.2.3 Cigarettes

Cigarettes;

7.2.4 Unlicensed Substances

Unlicensed marijuana or other psychoactive plants;

7.2.5 Subscription Products

Subscription-based nutrition, vitamins, supplements, herbs, or natural health products;

7.2.6 Illegal Activities

Items that instigate, induce, facilitate, or direct others to engage in illegal activities;

7.2.7 Stolen Items

Stolen items, including digital and virtual items;

7.2.8 Hate and Violence

Items that incite hatred, violence, racial or other forms of prejudice, or exploit criminal activity;

7.2.9 Obscene Material

Obscene material;

7.2.10 Infringement

Items that infringe or violate any copyright, trademark, publicity or privacy, or any other proprietary rights under the laws of any jurisdiction;

7.2.11 Pornography

Certain pornographic items or services;

7.2.12 Weapons

Ammunition, weapons, or certain weapon parts or accessories;

7.2.13 Regulated Weapons

Certain weapons or knives regulated by applicable law.

7.3 Other Prohibited Transactions

In connection with the following transactions:

7.3.1 Personal Information

Displaying personal information of a third party in violation of applicable law;

7.3.2 Pyramid Schemes

Supporting pyramid schemes, Ponzi schemes, matrix schemes, other get-rich-quick schemes, or certain multi-level marketing schemes;

7.3.3 Financial Products

Transactions related to the purchase of annuities or lottery contracts, advance deposit purchase systems, offshore banking, or transactions to finance or refinance credit card debt;

7.3.4 Uncontrolled Items

Selling certain items before the seller has control or possession of the items;

7.3.5 Payment Processing

Payment processors collecting payments on behalf of merchants;

7.3.6 Financial Instruments

In connection with the sale of travelers’ cheques or money orders;

7.3.7 Currency Exchange

Involving a currency exchange or cheque cashing business;

7.3.8 Credit Repair

Involving certain credit repair or debt settlement services, credit card transactions, or insurance activities;

7.3.9 Bribery and Corruption

Involving making or receiving payments related to bribery or corruption.

7.4 Fraudulent Products

Involving the sale of products or services determined by government agencies to be potentially fraudulent.

You are legally responsible for your actions in using Cndepot’s Services. You shall bear legal liability in the form of, but not limited to, compensation for the infringed party, and after Cndepot first assumes legal liability for administrative punishment or infringement damages caused by the user’s actions, you shall compensate Cndepot for an equal amount of compensation and other losses incurred by Cndepot thereof.

8. Liability for Compensation

8.1 Losses

If Cndepot and/or its affiliates suffer losses as a result of your actions (including direct economic losses, loss of goodwill, and indirect economic losses such as compensation, settlement, attorney’s fees, preservation insurance, legal costs, etc.), you shall indemnify Cndepot and/or its affiliates for all such losses.

8.2 Third-Party Claims

If Cndepot and/or its affiliates are subjected to a third party (including but not limited to sellers on platforms like Taobao, 1688, etc.) claim as a result of your actions, Cndepot and/or its affiliates may recover all losses from you after assuming obligations such as monetary payment to the third party.

9. Governing Law and Jurisdiction

9.1 Governing Law

These Service Agreement and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of HK.

9.2 Dispute Resolution

Any dispute arising out of your use of Cndepot’s Services and in connection with Cndepot’s Services shall be settled by Cndepot through negotiation with you. If no agreement can be reached through negotiation, either party may bring a lawsuit to the court with jurisdiction in the place where these Terms are signed.
